Official Contest Rules-As of 8/21/08
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.
1. How to Enter
a. The 103.7 WSOC/ WFNZ & Kia Motors’ 2009 Kia Borrego Car Giveaway Contest will begin on Friday, August 22, 2008 at 9:00 a.m. Eastern Time (“ET”) and end on Thursday, September 18, 2008 at approximately 10:00 a.m. ET.
b. To participate in the contest, there two (2) ways to enter:
1. Internet Entries: Beginning at 9:00 am ET on Friday, August 22, 2008, log onto www.wsocfm.com, or www.wfnz.com, go to the KIA page, click on the contest link and complete an official entry form including your first name and last name, complete address, city, state, zip code, home telephone number, a valid email address, and birth date. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email addresses or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of the Station and will not be acknowledged or returned. For purposes of these Official Rules, “receipt” of an online entry will be solely determined when the www.wsocfm.com, web server records the entry information. Any automated computer receipt (such as one confirming delivery of email) does not constitute actual receipt of an entry form for purposes of these Official Rules. WSOC’s computers are the official time keeping device for this contest. Use of any device to automate entry is prohibited. All online entries must be received by Wednesday, September 17, 2008 at 10:00 p.m. ET.
2. Enter On-Site. Beginning on Friday, August 22, 2008, visit one of the twelve (12) Kia Motors dealerships listed below during regular business hours and complete an official entry form, available while supplies last, including full name, complete address, city, state, zip code, home phone number, valid email address, and date of birth and drop the form in the designated entry box. All on-site entries must be received by 9:00p.m. ET on Wednesday, September 17, 2008.

c. WSOC-FM and WFNZ (the “Stations”) are not responsible for lost, late, stolen, mangled, incomplete, illegible or untimely entries. The Stations are not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.
d. Limit one entry per person and/or per email address, regardless of method of entry.
2. Eligibility Restrictions:
a. The contest is open to all listeners of the Stations who are 18 years of age or older and reside in North Carolina or South Carolina. Employees of Kia Motors, the Stations, their licensees, corporate parent, affiliated entities, their affiliated advertising agencies, participating sponsors/promotional partners, other radio stations in the Charlotte metropolitan area and the members of their immediate families and/or households are ineligible to participate or win. Subject to all applicable federal, state and local laws and regulations.
b. Listeners are eligible to win a contest administered by any of the Stations only once every sixty (60) days, and a prize valued at $600 or more only once every six months. Only one winner per household/per family is permitted in any contest.
c. Winner will be required to sign a release and present valid government issued photo identification to claim prize.
d. Winner must have a valid driver’s license and car insurance to receive the prize.
3. Prizes:
a. One (1) prize will be awarded. The prize is a 2009 Kia Borrego, courtesy of Kia Motors. Vehicle comes equipped with all “standard” features and options. See http://www.kia.com/borrego/borrego-features.php for details. Approximate Retail Value: $32,795.
The Winner will be solely responsible for any applicable vehicle title, license, registration, waste tire and lead acid fees, freight, delivery, dealer prep, and emissions inspection charges, additional equipment, all federal, state and local taxes, insurance, gasoline, vehicle maintenance, and all other fees and expenses not specified herein associated with the receipt and use of this prize vehicle. The winner will accept the chosen prize vehicle "as is." The Station accepts no responsibility for repairing any real or supposed damage to the prize car. Any additional car options (including but not limited to the interior and exterior color of the vehicle) not specified herein are subject to availability and will be the responsibility of the grand prize winner. The winner must provide proof of insurance and a valid driver’s license to take delivery and must arrange with Kia to take delivery on a date and at a location specified by Kia. The Station has not made and are not responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the G vehicle, including without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer's warranty that may apply to the vehicle, which is responsibility of Kia.
b. There is no substitution, transfer, or cash equivalent for prizes, except that Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. Selection of Winners:
a. Decisions of Station management with respect to the contest are final.
b. One (1) winner will be selected at approximately 10:00 am on September 19, 2008 in a random drawing of all eligible entries received.
c. Winner will be contacted by telephone immediately following the prize drawing. If winner cannot be contacted by 5:30p.m.ET on September 19, 2008 then winner forfeits prize and an alternate winner will be selected in a random drawing of all remaining eligible entries.
d. Winner must be able to appear at the Kia Motors Hickory Golf Classic located at the Rock Barn Golf and Spa, 3791 Clubhouse Drive in Conover, NC 28613 on September 20, 2008 to participate in the prize ceremony. If winner cannot or does not attend the event then winner forfeits prize and an alternate winner will be selected in a random drawing of all remaining eligible entries.
e. Odds of winning depend on the number of entries received. Winner need no listen to win.
f. Winner must execute and return any required Affidavit of Eligibility/Release of Liability Prize Acceptance Form by September 20, 2008 or prize will be forfeited. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize.
5. Conditions:
a. Payments of all federal, state and local taxes are solely the responsibility of the winner. Winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.
b. By participating in the contest, the winner agrees to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require contest winners and their guests to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
d. Stations in their sole discretion, reserve the right to disqualify any person tampering with the entry process, or who is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by telephone virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. The Stations reserves the right to make changes in the rules of the contest, including the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of Stations any contest or prize related events are delayed, rescheduled, postponed or cancelled, Stations reserve the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.
f. Failure to comply with the contest rules may result in a contestant’s disqualification at the sole discretion of Stations.
g. Stations are not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.
h. Copies of the written contest rules and a list of winners (when complete) are available during regular business hours, 8:30 a.m.-5:30 p.m. at the main studios of WSOC and WFNZ, 1520 South Blvd., Suite #300, Charlotte, N.C. 28203.
5. Internet Contest Privacy Policy:
